CFTC-CME Perpetual Futures Dispute
The CFTC filed a motion to dismiss the CME Group's lawsuit challenging the regulator's approval of Kalshi's cryptocurrency perpetual futures contracts. CFTC lawyers characterized the dispute as 'much ado about nothing,' contending that CME lacked standing to challenge the order because the company could not demonstrate concrete financial harm from the approval.
The regulator's core position holds that its order permitting Kalshi's Bitcoin perpetual contract does not prevent other designated contract markets, including CME itself, from listing comparable products. This interpretation suggests the CFTC views the approval as opening a product category rather than granting exclusive rights to Kalshi.
Regulatory Landscape: State vs. Federal Authority
Michigan authorities continue attempting to block Kalshi operations within the state despite federal CFTC approval, placing the company in a jurisdictional conflict. Kalshi previously stated it had been directed by federal authorities to disregard a Michigan restraining order issued in June, highlighting tension between state and federal regulatory frameworks.
