Legislative Gridlock Over Clarity Act Framework
The long-awaited Cryptocurrency Clarity Act, which passed the House more than a year ago and cleared Senate Banking Committee in May, continues to languish without a floor vote. Recent reporting indicates that bipartisan Senate negotiators have drafted revised language addressing Trump administration concerns regarding the bill's ethics provisions, with insiders suggesting the changes could secure sufficient votes for passage.
However, significant obstacles remain. Senator Cynthia Lummis and other pro-crypto lawmakers have publicly criticized Democratic senators for delaying proceedings, while Democratic lawmakers are pushing for additional law enforcement modifications to the bill's framework. The banking lobby has also been cited as a partial source of obstruction this year.
Industry figures have escalated pressure on lawmakers, with crypto conglomerate DCG warning the Senate that failure to pass the Clarity Act could result in competitive disadvantage relative to jurisdictions like Singapore and the UAE. SEC Chair Atkins has signaled the agency stands ready to establish crypto rules through regulatory channels if legislative efforts fail.
