Legislative Status and Support
The Crypto Clarity Act has secured backing from multiple constituencies, including SEC Chairman Paul Atkins, who stated he is 'committed' to helping advance the bill, and crypto industry leaders including DCG, which warned the Senate that failure to pass the legislation could cede regulatory ground to Singapore and the UAE. The bill cleared the Senate Banking Committee in May but has not yet received a floor vote.
Democratic lawmakers continue to advocate for the bill's passage, though with proposed modifications. Reports indicate that some lawmakers are pushing for changes centered on law enforcement provisions, suggesting internal disagreement over the bill's final structure. The banking lobby has been cited as a source of friction slowing the bill's progress this year.
Regulatory Alternative and International Competition
SEC Chair Atkins signaled that if the Clarity Act stalls, the SEC stands ready to provide crypto rules through its own regulatory authority, creating a potential bifurcated regulatory pathway. This dual-track positioning—legislative passage versus regulatory rulemaking—reflects tension over whether Congress or the SEC should take the lead in establishing crypto market structure.
