SEC Proposes Regulatory Pathway Amid Legislative Uncertainty
The Securities and Exchange Commission has published proposed rules designed to provide companies with safe harbor protections from tokens being classified as investment contracts, along with certain exemptions for token issuance. This regulatory initiative comes after the Senate failed to advance the CLARITY Act, which would have established the first comprehensive U.S. cryptocurrency regulatory framework.
SEC Commissioner Hester Peirce characterized the proposed rules as an "important" step forward from what she termed "inapt" existing crypto rules. The proposal reflects regulatory agency action to fill the legislative void, establishing clearer expectations for token offerings and compliance pathways.
Separately, the SEC has approved transfer agent registration for an affiliated entity of Injective, enabling it to maintain securities ownership records for tokenized asset services. This development represents institutional infrastructure expansion within the regulated framework.
